GREATEST ACHEIVEMENT THUSFAR: Defend The Bay Defeats Irvine Co. in Another Major Court Victory.
In an unusually harsh opinion, the Court found that Irvine Company’s plan failed to comply with the clear requirements of state law. Defend The Bay objected to the project because it would destroy open space and threaten water quality, among other detrimental effects. The Court agreed that the project approval was illegal. The City of Irvine’s reaction to the loss—characterizing its actions as "excellent" in the face of the judge’s indictment of its procedures—highlights the battle that Defend The Bay faces in protecting Newport Bay against callous indifference exhibited by many elected officials. The Daily Pilot remarked in an editorial that Defend The Bay "deserves our thanks for an uncanny string of legal victories against developers, cities, and water districts." We agree that Defend The Bay’s wins are "important victories for us all." Thanks to supporters like you, Defend The Bay is able to defend Newport Bay and our coastal waters against illegal developments that would run roughshod over our precious resources and the quality of life that many of us moved to the region to enjoy.
